The purpose of this Policy is to describe how the data of users and visitors of this website, reachable at https://habita79.it/, are processed.
Please read this document carefully before providing any personal data. The following information is given in accordance with European Union legislation on the processing of personal data (General Data Protection Regulation 2016/679 – GDPR), with the Italian Personal Data Protection Code (Legislative Decree 196/2003) and with the standards set by the Italian Data Protection Authority and the European Data Protection Board.
Data controller
The data controller (hereinafter the «Controller») is Diomira S.p.A. – VAT no. 06934661213 – with registered office in Naples, via Francesco Crispi 97, 80100 – in the person of its legal representative pro tempore.
Scope of this Policy
This Policy applies exclusively to this website and not to other third-party websites the User may reach through links (redirects). Interactions with such sites, and the information they collect, are governed by the privacy policies of each site and by the privacy settings the User has chosen there.
Using the social media features on this Site does not automatically give the Company access to the User’s personal data. However, if the User is logged into a personal account when a social plug-in is activated, the social network may associate the visit to our pages with that account. Data transmissions between the social network and the User’s system are governed solely by the data protection rules of the respective social network.
Service-specific notices
This website is used to provide information about the services and activities of Diomira S.p.A. Wherever a form collects personal data, a specific notice sets out the features of the processing and all other information required by law (art. 13 GDPR).
Browsing data
The IT systems and software procedures running this website collect information during standard operation, as the exchange of such information is inherent to internet communication protocols. This category includes: IP address, browser type, operating system, the domain and website the user comes from or leaves to, the pages visited, access time, time spent on each page, internal navigation paths and other parameters relating to the user’s operating system and computing environment. This technical data is collected and used only in aggregate form and is not immediately identifiable. It may be used to establish liability in the event of computer crimes against the site, or at the request of public authorities.
Contact form
The form on the Contact page collects the data the User chooses to enter: first and last name, email address, telephone number, arrival and departure dates, number of guests and the message. Name, email and message are required in order to reply; the other fields are optional.
This data is processed for the sole purpose of answering the request received (art. 6.1.b GDPR, pre-contractual measures at the request of the data subject) and is delivered to the hotel’s mailbox. It is not used for marketing, nor shared with third parties. The message is kept for as long as needed to handle the request and any resulting correspondence.
For security reasons the system records the originating IP address for the sole purpose of limiting automated submissions and abuse of the form.

Processing methods and retention
Data is processed mainly by electronic means. Users’ personal data is kept for the time strictly necessary to pursue the purposes indicated above, in compliance with legal (civil and tax) retention obligations and the limits set by law. Once those terms expire, the data is destroyed, erased or transformed into a non-intelligible form, unless further needs justify its retention (e.g. pending litigation).
Providing data is optional
Providing personal data is optional unless otherwise specified; however, failure to provide it may make it impossible to obtain the requested service or carry out the requested activities.
Place of processing
Personal data is managed and stored on servers of the Controller and of the third-party company appointed to manage and maintain the website, duly appointed as data processor, located within the European Union. Should further transfers outside the EU become necessary, they will always take place in accordance with art. 45 et seq. GDPR, entering into agreements ensuring an adequate level of protection and/or adopting the standard contractual clauses issued by the European Commission.
Disclosure of data
Only duly authorised and instructed persons acting on behalf of the Controller have access to the personal data acquired through this website.
Personal data may also be shared with suppliers of services instrumental to those provided by Diomira S.p.A. (e.g. technical maintenance companies, hosting providers, communication agencies), acting as data processors under specific agreements pursuant to art. 28 GDPR. Data is not disclosed to unspecified recipients.

Your rights
Data subjects may exercise the rights granted by art. 15-22 GDPR. In particular, they have the right to access their data, learn its content and origin, verify its accuracy or request its integration, updating or rectification. They also have the right to request erasure, anonymisation or blocking of data processed in breach of the law, and to object to processing on legitimate grounds.
Should the Controller fail to respond, or respond only in part, the data subject may lodge a complaint with the Italian Data Protection Authority or bring the matter before the competent court.
